Minimum Weekly Compensation Benefit Rate Increases

The New York State workers’ compensation “minimum benefit rate” has increased again. In accordance with legislation signed into law by Governor Kathy Hochul on September 6, 2023, New York State increased the minimum weekly benefit rate for workers’ compensation indemnity benefits effective January 01, 2024.

New legislation passed which has now increased an injured worker’s minimum benefit rate from $150.00 to $275.00 per week. This new increase took effect on January 01, 2024 and pertains solely to any accidents or dates of disablement occurring on or after this date.

Per the NYS Worker’s Compensation Board website, any employee whose wages are less than the minimum weekly benefit, will receive full wages. Minimum rates are scheduled to increase annually going forward. The minimum rate is again scheduled to increase to $325.00 per week on January 01, 2025.
